Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Fortnote mobile application (“App”) and the website located at fortnote.app (“Website”). The App and Website are operated by Nobel Future Systems Ltd (“Fortnote”, “we”, “us”).

1. Acceptance of These Terms

By downloading, installing, accessing, or using Fortnote, you agree to be bound by these Terms. If you do not agree, do not use the App or Website. If you are using Fortnote on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. What Fortnote Provides

• Offline notes. Your notes are stored on your device and are not synced by us to any cloud service.
• Local encryption. Notes are encrypted on-device. We do not have access to your note content.
• Optional purchase validation. If you purchase Pro features, the App may connect to the internet to validate or restore your license. This does not upload or read your note content.

3. Eligibility

Fortnote is not intended for children under 13. If you are under the age required to consent to these Terms in your jurisdiction, you must not use Fortnote.

4. Your Responsibilities

• Device security. You are responsible for securing your device and your unlock method (biometric/PIN/passcode).
• Backups. If you export or back up your notes, you are responsible for storing the exported files safely.
• Content. You are responsible for the content you write or store using Fortnote and for using the App lawfully.

5. Pro Features, Purchases, and Refunds

Fortnote may offer optional paid features (“Pro”). Purchases are processed by the app store (e.g., Google Play / Apple App Store), and your transaction is subject to that store’s terms and policies.

• License. When you purchase Pro, you receive a personal, non-transferable license to use those features on supported devices.
• Restore. If supported by your store account, you may restore purchases on eligible devices.
• Refunds. Refund requests are handled by the app store, not by Fortnote. Please refer to your store’s refund policy.

6. Privacy

7. Security Disclaimer

Fortnote is designed to help protect your notes using encryption and device security features. However, no software can guarantee absolute security. Risks may increase on compromised devices (e.g., rooted/jailbroken devices) or if malware is present. You are responsible for using Fortnote in a way that matches your threat model.

8. Prohibited Use

You agree not to:

• Use Fortnote in violation of applicable laws or regulations.
• Reverse engineer, decompile, or attempt to extract source code except to the extent permitted by law.
• Interfere with the App, attempt to bypass licensing checks, or exploit vulnerabilities.
• Use the Website to attempt to disrupt services or access systems without authorization.

9. Intellectual Property

Fortnote, including its name, logos, design, and software, is owned by Nobel Future Systems Ltd and protected by applicable intellectual property laws. These Terms do not grant you ownership of Fortnote or any of our trademarks.

10. Availability and Changes

We may update or change Fortnote (including features) from time to time. We may also suspend or discontinue the Website if needed. We aim to keep the App stable and reliable, but we do not guarantee uninterrupted availability.

11. Disclaimers

Fortnote is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Nobel Future Systems Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, or business arising from or related to your use of Fortnote. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Termination

You may stop using Fortnote at any time by uninstalling the App. We may suspend or terminate access to the Website if you violate these Terms or if necessary to protect Fortnote, users, or systems.

14. Governing Law

These Terms are governed by the laws of England and Wales. Courts in England and Wales will have jurisdiction, except where mandatory consumer protections apply.
